Proposed guidelines, that were to be published by the UK Gambling Commission ('Commission'), in relation to certain TV game shows (Deal or no deal and Red or Black?) and their affiliation with games of chance under the Gambling Act 2005 ('Act'), have now been put on hold.

Despite the Commission confirming that investigations are 'on-going' as whether TV game shows require gambling licences, the Commission has decided not to print any guidance for TV broadcasters and producers on how to comply with the Act at the moment. It is not known if they are going to do it at a later date.

The apparent change of stance comes after the plans have received a fairly robust response from the TV industry. Clearly, various arguments were put forward on behalf of broadcasters that led the Commission to retreat, at least for now, from its initial position.
